“The news that Volkswagen has been fixing their emissions testing results has shaken the entire automotive industry to the core. Regulators, the press and the public have immediately started looking for answers as to how this development was initiated and how high up the tiers of the organisation it was known. Was this a rogue engineer or an agreed upon company strategy? Communications going back a number of years, from people across the entire company, will be the key source of evidence to identify those responsible. Emails, calendar notes, memos and IMs must now be investigated and each thread followed to the end. General Counsels throughout the car manufacturing industry should be encouraged to enforce a data preservation notice to all staff, banning any destruction of data or devices , so that they are able to investigate matters fully. The regulators will want evidence that no stone has been left unturned in this investigation, so that the correct individuals or organisations see justice.”[/su_note][su_box title=”About Proven Legal Technologies” style=”noise” box_color=”#336588″]At Proven Legal Technologies, formerly Palmer Legal Technologies, we have the sector’s foremost experts at our clients’ disposal to advise them on addressing the rigours of regulatory response, forensic investigations and e-disclosure processes.[/su_box]
